I'm pretty sure that Val's ZFS is patented to hell and back. I left Sun in 2001 and at that time the drive to patent everything was extremely strong. The management sent task forces which pestered engineers to submit everything, and I do mean every little thing. Engineers received significant monetary awards ($2,000 IIRC) for every patent application submitted to Legal (which took care of properly formulating it and submitting it to USPTO), regardless of the content or if it ever made it to actual patent.

Come to think of it, didn't NetApps' WAFL related patents stood in the way of Phased-Tree filesystem? My memory is getting foggy now. Must... Google...
